Official Rules

1.      Introduction. The SAP Innovation Awards Program (“Program”) is a skill based contest in which Entrants will  submit an Entry Form and Pitch Deck provided by Sponsor demonstrating how  an SAP Customer  has successfully deployed a business application that utilizes SAP HANA, SAP Leonardo, SAP Cloud Platform, SAP Analytics, S/4HANA, or another SAP platform technology in their organization; or in the case of the Next-Gen Innovator Award how an SAP Partner or SAP StartupFocus Member  with a validated solution  (SAP Partners and StartupFocus members will collectively be referred to as “Partner(s)”), has built  an application using SAP HANA, SAP Leonardo, SAP Cloud Platform, SAP Analytics, S/4HANA, or another SAP platform technology that is intended to be sold to and used by customers (an “Entry”).   Note that in addition to the Eligibility requirements in Section 3, below, the business application that is the subject of the Entry must be deployed in an Eligible Country, or in the case of the Next-Gen Innovator Award have been developed and intended to be sold to and used by customers in an Eligible Country.

2.      Term. Eligible Entrants may participate in the Program by submitting an Entry from October 5th, 2017, at 9 a.m. Pacific Time (“PT”) to March 2nd, 2018, at 6 p.m. PT (the “Program Period.”). Entrants are required to determine the appropriate beginning and ending times in the Program Period for their respective jurisdictions.

3.      Eligibility. Entrants must (i) be above the age of majority in their place of residence; (ii) reside in one of the Eligible Countries (the individual who submits the Entry and the representative of the SAP Customer or Partner that is the subject of the Entry, if submitted by a third party); (iii) be an employee of the SAP Customer or Partner whose Entry is being submitted (or alternatively be an employee of a third party entity that has a business relationship with the customer) (“SAP Customer”); and (iv) whether you are an employee of the SAP Customer or Partner, an employee of the third party submitting on behalf of the SAP Customer, you must have the express prior authorization of the SAP Customer or Partner to enter the Program on behalf of the entity they are representing subject to the Official Rules (“Entrant(s)”). For avoidance of doubt, all references to “Entrant(s)” and the rights and obligations associated with these references shall include and apply to the entity on whose behalf the Entry is submitted.

Individuals who are employees, officers, directors, agents, or partners of Sponsor and its respective parents, subsidiaries, affiliates and advertising and promotion agencies (collectively, “Program Entities”), and the immediate family members (spouses, domestic partners and parents, children and siblings and their spouses or domestic partners, regardless of where they live) or members of the same households (whether related or not) of such individuals are not eligible to win. EMPLOYEES OF THE UNITED STATES GOVERNMENT OR THE GOVERNMENT OF ANY U.S. STATE, U.S. TERRITORY, OR FOREIGN STATE OR TERRITORY (“GOVERNMENT ENTRANTS”) MAY ONLY PARTICPATE UNDER THE LIMITED CIRCUMSTANCES SET FORTH IN THESE OFFICIAL RULES. SAP reserves the right to verify eligibility and to adjudicate in its sole and absolute discretion on any dispute related to this Program at any time. The Program is subject to all federal, state, and local laws and is void where prohibited. Entrants in the Program agree to be bound by these Official Rules and the decisions of the Sponsor.

Entrant warrants that the appropriate corporate officers, executives, managers or other persons of the entity on whose behalf the Entry was submitted have approved the Entry, and understand and agree that these Official Rules will be binding on both the individual submitting the Entry and the entity on whose behalf the Entry was submitted. The Entrant understands that if the Entry is submitted without obtaining the appropriate approval, Sponsor may, in its sole discretion, disqualify the Entrant, the SAP Customer, Partner, and the Entry. Furthermore, in the case of a third party entering on behalf of an SAP Customer, participation by Entrant is subject to Sponsor receiving written confirmation from an authorized representative of the SAP Customer indicating the SAP Customer’s acceptance of the Official Rules.

4.      Entry Categories . The award will recognize up to 23 winners across seven (7) Entry Categories (as defined below).  All entries, aside from those for the Next-Gen Innovator category, must describe live deployments involving SAP solutions. Entries will be assigned to one or more of these categories by the SAP Award Team and will be judged against other entries assigned to that category. The categories, are as follows:

a)     Digital Transformation : Entrants should present stories about how they are using technology to enable something entirely new or radically different in their business and not just making improvements, however impressive, to existing business practices or processes.  Examples of transformative change include enabling new business models, opening new markets, or radically changing how products or services are created and delivered. The transformation could also involve redefining the customer or end user experience, or it could be about how the company collects, processes and interacts with data and information in significantly new ways. Up to six (6) Digital Transformation awards will be given.

b)     CEO Choice Award: Entrants should be present stories of how they are using technology that best exemplifies SAP’s ultimate vision of digital transformation and most effectively demonstrates how to use SAP technologies to lead an industry and succeed in today’s dynamic and digital economy. We aim to recognize the customer with both the most significant scope and impact of positive change on their business, as well as the most impressive or creative use of technology to drive that change. SAP’s CEO Office will collaborate with the Innovation Award judges to select the entry to be awarded CEO Choice.

c)      Industry Disruptor: Entrants should be present stories of how the deployment of SAP technologies have radically changed the dynamics in an industry, providing significant business value and improved their companies’ competitive positioning.  Finalists for this award will highlight how they disrupted the way business is conducted in their industry. For example; establishing new business models, redefining a critical business process, or enabling strategies that break through existing boundaries.

d)     Process Innovation: Entrants should be present stories of how they are using technology to re-imagine and drive significant improvements to existing business processes resulting in measurable business impact.  These awards will be given to entries that show how SAP technologies have enabled substantial gains in process efficiencies, cost structures or overall operations. Examples of Process Innovation include shorter cycle times, faster time to market, reduced hardware requirements, lower overall technology costs, fewer required support resources, improved customer or end user experience, and better overall profitability. Up to six (6) Process Innovation awards will be given.

e)     Social Hero : Entrants should present stories how SAP technologies can be used for significant social impact.  For example, an entry that enables dramatic changes in how people live their lives (smarter homes), significant improvements in public services (city of the future, social services), one that contributes to public health or that creatively addresses a societal challenge (e.g. environment).

f)       Next-Gen Innovator. Entrants should present stories that demonstrate how using SAP platform technologies can enable development of innovative applications to deliver significant business impact.  Either a live customer deployment or POC verified by at least one customer is required for the winner of the Next-Gen Innovator award.  The Next-Gen Innovator award will recognize the Partner or Customer who has developed a compelling application and has proven significant impact or potential through a proof of concept (POC).

g)     Regional Choice: Entrants should present stories about Process Innovation, Digital Transformation or Next-Gen Innovation. A Regional Choice award will be given to one entry in each of SAP’s seven global regions that is judged to be the most compelling example of innovation and significant business impact driven by the deployment of one or more of the SAP technologies.  The regions include:

1.      Latin America (LATAM)

2.      North America (NA)

3.      EMEA North

4.      EMEA South

5.      Middle & Eastern Europe (MEE)

6.      Asia Pacific and Japan (APJ)

7.      Greater China (GC)

 

5.      How to Enter . Entrants should submit an Entry Form and Pitch Deck, which includes a Power Point or similar template for describing the use case for your Entry, via e-mail. The form of the Entry can be found at www.sap.com/idea-place/sap-innovation-awards-2018 . Entrants must complete all fields in the Entry Form to qualify. Entries must be in English. If an Entry is incomplete or does not comply with the specifications and rules, then the Entry will be disqualified. Sponsor is not responsible for lost, late, incomplete, misdirected, or delayed Entries, nor is Sponsor responsible for failed Internet connections, unavailability of servers or any other technical malfunctions for any reason. Entrants should retain a copy of all materials submitted for the Program, as Sponsor will not return any of the Entries. All decisions by Sponsor and Judges are final and absolute and are not subject to inquiry or appeal. No purchase or payment is required to enter, and any expenses Entrants voluntarily incur during the submission process are their sole responsibility.

6.      Special Recognition . Entrants will have the option to enter the SAP Partner that encouraged the Entrant to enter the Program on the online entry form when submitting an Entry. Each Partner that is identified on the entry form will be eligible for special recognition by SAP at the SAPPHIRE NOW (“Sapphire Event”).

7.      Judging and Winner Notification . Eligible Entries will be judged against the other Entries in their respective Entry Categories as determined the Award Team. There will be one (2) rounds of judging.

o   Round 1:  Award committee will select up to 10 entries as finalists per category between Mar 3rd and Mar 20th, 2018 to go thru to Round 2 judging

o   Round 2: Judging will take place between Mar 26th and Apr 10th, 2018. Each of the finalist in each Entry Category will be judged by a group of qualified judges consisting of Sponsor’s employees and/or non-employee judges selected by Sponsor (“Judges”). Judges will review the finalist.  Entries with the highest score(s) in each Entry Category will be determined to be the winners in that Entry Category. Each Entry will be evaluated by the Judges based on the following criteria (each of which will be equally weighted):

1.      Creativity or Complexity of the Use Case - To what degree does the entry demonstrate innovative thinking, creativity and complex application of technology to business challenges?

2.      Business or social value created - To what degree has the project impacted the business? Or to what degree has the solution enabled the company to significantly impact serious social challenges or community needs or services?

3.      Human Empowerment - How much does the project impact how a person does their job? Or How much does the project change the way customers or users interact with the company?

4.      Quantifiable Results - To what degree do the quantifiable business benefits impact the business

5.      Embracing the potential for digital transformation - To what degree does the entry demonstrate that the company recognizes the potential for digital transformation and is applying innovative thinking and new ways of working across the company?


In the event of a tie, the Entry that received the higher score from the Judges in the category of “Embracing the potential for digital transformation” will be selected as the winner. In the event a winner is disqualified for any reason, the Entry that received the next highest total score will be chosen as the winner.

Winners will be notified on or about April 19th, 2018, and notified by telephone or email at Sponsor’s discretion. If a winner does not respond to the notification attempt within twenty-four (24) hours from the first notification attempt, then such winner will be disqualified and an alternate winner will be selected. With respect to notification by telephone, such notification will be deemed given when a winner engages in a live conversation with Sponsor or when a message is left on the potential winner’s voicemail service or answering machine by the Sponsor, whichever occurs first. 

Except where prohibited by law, the winners may be required to sign and return a Declaration of Eligibility and Liability and Publicity /Photo Release and provide any additional information that may be required by Sponsor. If required to submit documents prior to receipt of any prize, winner must return all such required documents within three (3) days following attempted notification or such potential winner will be deemed to have forfeited the prize and another winner will be selected based on the judging criteria described herein. All notification requirements, as well as other requirements within these Official Rules, will be strictly enforced.

8.      Prizes. Prizes will be awarded to the top entries with the highest score(s): The six (6) winning Entries in both the Digital Transformation and the Process Innovation Categories (for a total of twelve (12) awards), seven (7) (i.e., one for each region listed Section 4(g)) for Regional Choice and one (1) each for CEO Choice, Industry Disruptor, Social Hero and Next-Gen Innovator (4). Total of twenty three (23) winners will receive the following:

o   Select an Eligible Charity (defined below) to receive a $2,000 USD donation.

Winning Entries in each Entry Category who plan on attending the SAPPHIRE Event will also receive one (1) ticket to SAPPHIRE (Approximate Retail Value (“ARV”) $1,950). The SAPPHIRE NOW tickets will be awarded after the completion of the judging.  If no one representing a winning Entry is planning on attending SAPPHIRE NOW, the ticket will not be given to that winning Entry, and there will be no prize substitution, or prize of equal or comparable value awarded. Subject to Sponsor’s prior written approval and at Sponsor’s sole discretion, a winning Entry may designate a non-employee representative to attend the Sapphire Event.

NOTE: GOVERNMENT EMPLOYEES ARE NOT ELIGIBLE FOR THE PRIZES IDENTIFIED ABOVE, BUT MAY RECEIVE RECOGNITION FOR THEIR ACHIEVEMENTS IN THE FORM OF A COMMERATIVE PLAQUE OR SIMILAR.

A list of eligible charities (each an “Eligible Charity”) that may be selected for the donation will be made available to winners upon selection. Charitable donations are subject to final approval by Sponsor. Sponsor reserves the right to substitute another charity should one of the Eligible Charities listed be disqualified, deemed ineligible for whatever reason, or in the event that winner fails to designate an Eligible Charity, all of the foregoing in Sponsor’s sole discretion. Donations will be made in the name of Sponsor directly from Sponsor to Eligible Charity. Any tax benefits from donation will be for the benefit of Sponsor as Sponsor will be making the donation to the selected charity.

Odds of winning depend on the number of Entries received during the Program Period and the skill of the Entrants (i.e., the innovative nature of their solution, and the skill exercised in creating the entry). No other prize elements except those specifically described here are awarded. Prizes are not transferable and must be accepted as awarded, with no substitutions of any kind, except by the Sponsor, which reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value, at its sole discretion. All federal, state and local taxes, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the potential winner’s responsibility. All prize details are at the Sponsor’s sole discretion.

9.      Taxes. ANY PAYMENTS TO OR ON BEHALF OF POTENTIAL PRIZE RECIPIENTS ARE SUBJECT TO THE EXPRESS REQUIREMENT THAT THEY SUBMIT TO SPONSOR ALL DOCUMENTATION REQUESTED BY SPONSOR TO PERMIT IT TO COMPLY WITH ALL APPLICABLE UNITED STATES, STATE, LOCAL AND FOREIGN (INCLUDING PROVINCIAL) TAX REPORTING AND WITHHOLDING REQUIREMENTS. ALL GRANTS WILL BE NET OF ANY TAXES SPONSOR IS REQUIRED TO WITHHOLD. ALL TAXES IMPOSED ON THE PRIZE, OTHER THAN THOSE SPONSOR IS REQUIRED TO WITHHOLD, ARE THE SOLE RESPONSIBILITY OF THE PRIZE RECIPIENT.

10.   Intellectual Property Rights and Grant of License . Each Entrant shall retain ownership of all intellectual property rights in each Entry (including moral rights) subject to these Official Rules. However, by entering the Program, and to the extent allowed by law, each Entrant grants SAP and its affiliates, licensees, promotional partners, developers and third party marketing entities a non-exclusive, perpetual, worldwide, royalty-free license to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, adapt, publish, exploit and use the Entry, including without limitation the name and logo of the SAP Customer and/or Start-up/Partner, and the Entrant’s name, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation.

11.   Entrant Representations and Warranties . By entering the Program, Entrants represent and warrant that their Entries are their own original work and, as such, they are the sole and exclusive owner and rights holder of the submitted Entry and that they have the right to submit the Eligible Entry in the Program and grant all required licenses and assignments. Alternatively, in the event the Entrant is submitting the Entry on behalf of a customer or other business partner, the Entrant represents and warrants that it has been granted the right to submit the Entry, and that it meets the foregoing requirements. Each Entrant agrees not to submit any Entry that infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity, or confidentiality obligations. Entrant also warrants that he/she has permission from their employer or other appropriate party such as an SAP Customer or Partner to submit the Entry.

12.   Indemnity. To the maximum extent permitted by law, each Entrant indemnifies Program Entities at all times from and against any and all liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the Entrant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each Entrant agrees to defend, indemnify and hold harmless the Program Entities from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorney’s fees) arising out of or accruing from (i) any entry or other material submitted by the Entrant that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person; (ii) any misrepresentation made by the Entrant in connection with the Program; or (iii) any non-compliance by the Entrant with these Official Rules.

13.   Release, Publicity, and General Terms . By participating in the Program, Entrants: (i) agree, to the fullest extent of the law, to release and hold harmless Program Entities from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Program; and (ii) grant to Sponsor, its affiliates, licensees, promotional partners, developers and third party marketing entities the right to use and publish their  full name (first and last), the name and trademark(s)/logo(s) of their employer or the entity on whose behalf they are submitting the Entry, and state or province and/or country, statements, photograph, voice and/or likeness, and to assist Sponsor in obtaining the same from the SAP Customer in the event the Entrant is submitting the Eligible Entry on behalf of an SAP Customer or Partner, for any advertising and promotional purposes relating to the Program, in any media now known or hereafter devised, without further notice, compensation, consideration, review or consent and without regard to moral rights, except where prohibited by law.

Sponsor assumes no responsibility or liability for the following: (i) telephone or technical malfunctions that may occur; (ii) any incorrect or inaccurate information, any of the equipment or programming associated with or utilized in the Program, or any technical or human error which may occur in connection with the Program; or (iii) any injury or damage to participants related to or resulting from participating in the Program. If, for any reason, the Program is not capable of running as planned, including because of, tampering, unauthorized intervention, fraud, technical failures, force majeure, or any other cause beyond the control of Sponsor which may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Program, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Program, or disqualify an Entrant. Sponsor reserves the right to change these Official Rules at any time, with or without notice.

14.   Privacy. By participating in the Program, Entrant, and all of those identified in the Entry and Entry application, consents to the collection, use and disclosure of your personal information as described in these Official Rules and as described at http://www.sap.com/about/legal/privacy.html , including without limitation the addition of contact information, including person information, to the customer relationship management systems of Sponsor and its affiliated companies.

15.   Governing Law. These Official Rules are governed and interpreted by the laws of the State of New York, without regard to its conflict of law provisions.

16.   Rules & Winners . A list of winners will be available on or about May 1st, 2018 at www.sap.com/idea-place/sap-innovation-awards-2018 .
