Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN.  VOID OUTSIDE OF ARGENTINA, CANADA (EXCLUDING QUEBEC), CHILE, COLOMBIA, MEXICO, PERU, INDIA AND THE UNITED STATES (THE “ELIGIBLE COUNTRIES”) AND WHERE PROHIBITED BY LAW.

 

1. DESCRIPTION: Reboot the Earth: Virtual Challenge is a skill-based contest (the “Contest”) that is intended to encourage users of all skill levels to create insight driven stories using SAP Analytics Cloud. The contest is only available to Students aged 21-35 and will be scored and the top three finalists will be awarded prizes.

Students: Students enrolled at a post-secondary institution that have a valid email address associated with said institution.

 

2. SPONSOR: SAP America, Inc. (“Sponsor”), 3999 West Chester Pike, Newtown Square, PA 19073.

 

3. CONTEST ENTRY PERIOD:  The Contest begins at 09:00 AM Pacific Time (“PT”) on August 1st, 2019 and ends at 11:59 PM (PT) on August 28th, 2019 (“Contest Entry Period”). Entries, which include all components described in these Official Rules, must be received during the Contest Entry Period (or such other period of time within the Entry Period as designated in these Official Rules) by Sponsor in accordance with the procedure and approved channels stated herein, or will not be eligible.

 

4. ELIGIBILITY: The Contest is open to individuals (referred to as “Entrants”, or on occasion “you” or “your”) who:

 

a)     are Students;

b)     are aged between 21-35; and

c)     are legal residents of an Eligible Country. 

 

THIS CONTEST IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS.THIS CONTEST IS VOID TO RESIDENTS OF ALL OTHER COUNTRIES AND WHEREVER RESTRICTED BY, WITHOUT LIMITATION, FILING OR REGISTRATION REQUIREMENTS, OR OTHERWISE PROHIBITED OR RESTRICTED BY LAW. Individuals who are also employees, officers or directors of SAP and its affiliated companies (“Sponsor”) and its respective parents, subsidiaries, affiliates and advertising and promotion agencies (collectively, “Competition Draw  Entities”), and the immediate family members (spouses, domestic partners and parents, children and siblings and their spouses or domestic partners, regardless of where they live) or members of the same households (whether related or not) of such individuals are not eligible to win.  EMPLOYEES OF A GOVERNMENT OF A COUNTRY ELIGIBLE TO PARTICIPATE ARE EXCLUDED FROM PARTICIPATION.  SAP reserves the right to verify eligibility and to adjudicate on any dispute at any time.  YOU ARE PROHIBITED FROM PARTICIPATING IN THIS CONTEST IF YOU ARE ON THE U.S. TREASURY DEPARTMENT’S LIST OF SPECIALLY DESIGNATED NATIONALS. 

 

5. HOW TO ENTER: During the Contest Entry Period, Entrant must register for this Contest by providing the information requested (including a screen shot of your analysis) in the official entry form which can be downloaded here (the “Entry”). You will need to obtain access to SAP Analytics Cloud, which will be subject to additional terms and conditions. Information on SAP Analytics Cloud and how to obtain access to a trial/evaluation version or access to the SAP Analytics Cloud for Higher Education tenant (for Students) can be found here (https://www.sapanalytics.cloud/higher-education/). Entrants must use the SAP Analytics Cloud for Higher Education tenant and associated data models for all analysis. Entrants may also be required to provide general information such as the following: their full name, complete mailing address and country of legal residence, email address, and school name. Entrants may not edit or modify the Word template that they are required to submit as part of their Entry, and any Entry that Sponsor determines or has reason to believe has been edited or modified will be disqualified.  It is the Entrant’s sole responsibility to ensure Sponsor has their current contact information. In whole or in part invalid, non-compliant or incomplete Entries will not be considered. Sponsor may but is not obligated to request that an Entry be re-submitted for corrective reasons, so long as it complies with these Official Rules and is submitted by the same, eligible Entrant within the Contest Entry Period.

 

6. Reboot the Earth: Virtual Challenge Scoring (for the Prizes listed in Section 8, below):

Virtual Challenge Scoring will be done by the judging committee, which includes members from SAP, the United Nations and related partners throughout the evaluation period (August 29 – September 5, 2019).

 

Scoring for the contest will be judged based on the average score of all judges. The judging criteria may be viewed at the Contest page. If more than one Entry has the same average score, then the Entry that was submitted the earliest will be named the winner.

 

There will be a first place, second place, and third place winner. In the event a potential winner is disqualified for any reason, the Entry that received the next highest total score will be chosen as the potential winner. 

 

For purposes of these Official Rules, "receipt" of your Entry occurs when Sponsor’s server records the information resulting from Entrant clicking the "Submit" (or equivalent) button. Only one (1) Entry from each Entrant is permitted. Any automated computer receipt (such as an email confirming the Entry) does not constitute proof of actual receipt by Sponsor for purposes of these Official Rules.  Online Entries are subject to all notices posted online including but not limited to Sponsor’s terms of use and privacy policies on the Contest website. Sponsors are not responsible for lost, late, misdirected, ineligible, illegible, damaged, altered, or incomplete Entries.

 

In order to be eligible for this Contest, all Entries, in whole and in part (and the Entrant) must comply with all other terms stated in these Official Rules, including the requirements in Section 5. Entrants agree that neither Sponsor nor SAP are responsible for, and they shall be indemnified, defended, released and held harmless for/from any claims, actions or disputes between an Entrant and any other Entrant and/or third party relating to the Contest or any Entry, in whole or in part.  Once you submit your Entry, it is final and may not be modified or edited. No Entry will be returned.

 

The judging committee’s decisions are final and binding on all matters relating to this Contest.

 

7. INTELLECTUAL PROPERTY RIGHTS: With the exception of the rights granted in these Official Rules, as between Sponsor and the Entrant, the Entrant has and retains all intellectual and proprietary rights in and to the Entry that Entrant had at time of submission of the Entry. As a condition of entry, Entrant grants Sponsor, SAP, its affiliates, and others involved in the preparation of materials for, administration and execution of this Contest (“Contest Administrators”) a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license, with the right to grant sublicenses, to use, reproduce, publicly perform, and publicly display the Entry in whole or in part that Entrant submits to this Contest to  allow the Entry to be  evaluated for purposes of this Contest, to administer the technical and other requirements of the Contest, including distribution of the Entry to the Contest Administrators, for prize award verification, and for promotional purposes.

 

Entries may not be acknowledged and will not be received or held “in confidence” or “in trust” and by submitting an entry it does not create a confidential relationship or obligation of secrecy between Entrant and Sponsor, its affiliates, or any person or entity involved in the administration of the Contest. Entrants will not now or in the future be entitled to any approval, rights of compensation, or any other payment; unless adjudged and verified a winner pursuant to these Official Rules, and in such event, only to the extent of the prize award.

 

Not withstanding the foregoing SAP or its group companies may use in its business activities the ideas, concepts and know-how related to information technology which are contained in the Entries and retained in the unaided memories of SAP employees who have had access to such Confidential Information in connection with this Agreement.

 

8. PRIZES: Prizes will be awarded to the first place, second place, and third place winners (“Winners”) as set forth in Section 6, above.


The first place Winner will receive a round trip to New York City including round trip airfare and hotel accommodation from September 19 to 24, 2019, to participate in SAP planned activities and present their solution at the UN Youth Climate Action Summit at UN Headquarters in New York City on September 21, 2019.

 

Second Place Prize: Approximate Retail Value (“ARV”) $400: Nintendo Switch

 

Third Place Prize: Approximate Retail Value (“ARV”) $300: Bose Wearable AudioSunglasses

 

Odds of winning depend on the number of Entries received and the skill of the Entrants as determined under these Official Rules. No other prize elements except those specifically described here are awarded. Prizes are not transferable and must be accepted as awarded, with no substitutions of any kind, except by the Sponsor, which reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value, at its sole discretion. All federal, state and local taxes, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the potential Entrants responsibility (e.g., any customs duty). All prize details are at the Sponsor’s sole discretion.

IMPORTANT NOTICE FOR FINALISTS PRIZES (hereinafter “Prize” or “Prizes”): All transportation, lodging, meals, gratuities, and all costs and expenses relating to or arising directly or indirectly out of the Prizes not specified as included herein are the sole cost and responsibility of the first place Prize Winner.  Prizes must be taken on dates and times specified by Sponsor, which dates, and times are subject to change. All travel arrangements are made through a travel agent or entity selected by Sponsor and the first place Winner hereby acknowledges that specific Terms and Conditions related to the trip may apply. Specific air carrier(s), lodging providers and other trip specifics are at the sole discretion of Sponsor. Travel must originate and end at the same major gateway airport.  The first place Prize Winner will be required to provide valid travel documents and passports, visas if applicable, valid photo IDs, and inoculations as required by travel authorities at time of travel; and to obtain and maintain all insurance (including health, liability and any other insurance) and where in their state country still considered a minor, all necessary consents of their parental authorities. The first place Prize Winner acknowledges and agrees that Sponsor is not a provider/carrier of transportation, or insurance provider. No changes will be made to travel details once any element(s) of the travel arrangements have been booked. Prize conditions may be added or modified by Sponsor. Sponsor is not responsible for any changes of any element of Prizes including but not limited to any expenses incurred because of missed flights, flight charges, cancellation, or delays. Sponsor will not replace any lost or stolen tickets, travel vouchers, or certificates. Any unclaimed and/or unused element of a Prizes will remain the property of Sponsor.  In the event the first place Prize Winner engages in a behavior that, as determined by Sponsor (or its designee) in their absolute discretion, is obnoxious or threatening, dangerous, illegal, disorderly, or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the first place Prize trip early, in whole or in part, and to send the winner home with no further compensation.               

The Prize Winners are responsible for all federal, state, local, sales, income taxes and all expenses not specified herein.  The Prize Winner may be required as a condition of receiving the prize to provide the Sponsor with his or her social security number so that appropriate reports may be filed with the appropriate tax authorities.  If, for reasons beyond their control and not related to the Entry, the Sponsor is unable to award the Prizes as described in these Official Rules, they will substitute a Prizes of similar nature and equal or greater value at their sole discretion.  The Prizes are non-assignable and non-transferable.  The Prizes are not redeemable for cash except as indicated above.  A winner is not a recipient of the Prize until he/she has been verified or notified as a winner by the Sponsor or judges.  If selected Travel Prize winner is unable to accept the prize in its entirety, the selected Travel Prize winner will forfeit the Prize, and the Prize may be awarded to an alternate winner. 

Entrants acknowledge that the Sponsor and all other businesses concerned with this Contest and their agents do not make, nor are in any manner responsible for, any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the Prizes except that the prize shall be subject to manufacturer’s/provider’s standard warranty.

 

 

9. PRIZE NOTIFICATION:  Potential winners will be notified on or about September 5th, 2019, online, by email, and/or mail at Sponsor’s sole discretion based upon the information submitted by the Entrant. The Prize Winners may be required to complete, sign, and return an Affidavit of Eligibility and Release of Liability and Publicity Release (where permissible by law) (collectively “Affidavit”) within the time/date specified by Sponsor. Failure to comply within this time deadline will result in disqualification and the Entrant with the next highest score will be notified. If any Prize Winner cannot be contacted using the contact information provided on or within two (2) separate attempts, or if Affidavit/Release is returned as undeliverable, or if a Prize Winner cannot accept or receive the Prize that they were awarded for any reason, or any non-compliance with these Official Rules, that prize will be forfeited and awarded to the Entrant with the next highest score.

 

10. FREE STUFF: In addition to the award of prizes, Entrants may also receive SAP branded giveaways, while supplies last, or other secondary prize awards of nominal value chosen by SAP.  Any and all costs other than shipping are the responsibility of the recipient.

 

11. GENERAL ENTRY CONDITIONS: Sponsor is not responsible for problems uploading or downloading any Contest related information from the website or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic entry submission to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the website, or any other technical problems related to web site entries including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit an Entrant’s ability to participate in this Contest. If applicable, mass entries or entries generated by a script, robot, macro, or use of automated devices will be disqualified. Sponsor reserves the right to modify, suspend or terminate the Contest in the event it becomes infected by a computer virus or is otherwise technically impaired, and to cancel or suspend the Contest in its entirety should tampering, unauthorized intervention, fraud, technical failures or other causes beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. Sponsor reserves the right at their sole discretion to disqualify any individual they find to be tampering with the entry submission process or the operation of this Contest or web site or to be acting in violation of the Contest Official Rules.

 

Without limiting any other right or term herein, an Entrant may be disqualified from the Contest if, in Sponsor’s absolute discretion, it reasonably believes Entrant has, appears to, or has attempted to undermine the legitimate operation of the Contest by cheating, deception, fraud, using multiple identities, engaging in illegal activities, or other unfair practices, or has or attempts to annoy, abuse, threaten, harass or intimidate any other Entrant, or any other person.

 

Sponsor is not responsible if the Contest cannot take place or if any prize cannot be awarded due to travel cancellations, delays, or interruptions due to acts of God, acts of war, natural disasters, weather, or acts of terrorism. Sponsor reserves the right to cancel or suspend the Contest at its discretion. Sponsors are not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prizes.

 

12. PRIVACY: Entrants agree that personal data entered during the registration may be processed, stored, and otherwise used for the purposes and within the context of the Contest and as permitted by and in accordance with the Sponsor’s Privacy Policy found at https://www.sap.com/about/legal/privacy.html. This data may be collected and maintained within the United States or any other location subject to compliance of appropriate local privacy rules of the Entrants’ country. By entering, Entrants expressly agree to the transmission, processing, and storage of this personal data in the United States or any other host country of the Entrant.

 

13. LIMITATION OF LIABILITY. THESE OFFICIAL RULES SHALL GOVERN THE CONTEST, INCLUDING BUT NOT LIMITED TO ENTRY, PARTICIPATION, ELIGIBILITY TO RECEIVE A PRIZE, AND ENTRANTS AND OUR RESPECTIVE OBLIGATIONS WITH RESPECT THERETO. USE OF THE SITE, INFORMATION PRACTICES, AND ALL OTHER GENERAL TERMS ARE GOVERNED BY SPONSOR’S TERMS OF USE AND/OR PRIVACY POLICY AT SAP.COM. IN THE EVENT OF A DISCREPANCY BETWEEN ANY INFORMATION, COMMUNICATION, AND/OR TRANSLATION, THESE OFFICIAL RULES SHALL GOVERN ISSUES RELATING TO THE CONTEST. 

 

IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THIS CONTEST, PARTICIPATION IN THE CONTEST, ANY CONTEST ACTIVITIES OR ELEMENTS THEREOF, INCLUDING BUT NOT LIMITED TO THE SUBMISSION OF AN ENTRY, ENTRANT’S ACCESS TO AND USE OF THE PROMOTIONAL WEBSITES OR THE UPLOADING OF MATERIALS TO THE WEBSITE, AND/OR THE DELIVERY, ACCEPTANCE AND/OR USE/MISUSE OF A PRIZE.

 

14. RELEASE AND INDEMNIFICATION: To the maximum extent permitted by law, Entrants and winners agree to release, indemnify, defend and hold harmless (“release”) Sponsor, SAP, and their parents, affiliates, subsidiaries and divisions, and their respective directors, officers, employees and agents (“Released Parties”) from and against any and all threatened or actual actions, liabilities, claims, demands, losses, settlements, fines, damages, costs and expenses (including reasonable attorney fees) whether or not litigation is commenced (“dispute”) arising at any time from participation in the Contest, the Entries (in whole or in part), any Contest and/or prize-related activity. Entrants and winners covenant not to sue any Released Party or cause them to be sued regarding any matter released above; and further covenant not to disaffirm, limit, or rescind this release. A waiver by Sponsor of any term in these Official Rules does not constitute a waiver of any other provision.  Except where prohibited by law, acceptance of any prize constitutes permission for Sponsor and its designees to use the winner's name, likeness, statements, and other personally identifiable information provided in connection with the Contest for advertising and marketing purposes in any media throughout the world without any additional prize, incentive, consideration, consent or review.

 

15. APPLICABLE LAW: These Official Rules shall be governed by, subject to, and construed in accordance with the laws of the State of New York, United States of America, without regard to conflict of law rules. If any item or provision contained in these Official Rules or any part thereof is declared or becomes unenforceable, invalid or illegal for any reason, all other terms and provisions of these Official Rules shall remain in full force and effect as if these Official Rules had been executed without the offending provision appearing therein. 

 

16. NAMES OF WINNERS: Winners consent that they will be named and published on or about September, 2019. Visit the Contest page for results.

 

Sponsor reserves the right, without notice or prior approval, to modify or supersede these Official Rules in its sole reasonable discretion and in such event will post revised Official Rules on the web site, which will continue to govern all aspects of the Contest.
