THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.

 

1.      DESCRIPTION: The Analytics Designer Hackathon is a skill-based contest (the “Contest”) that is intended to encourage users of all skill levels to create insight driven applications using SAP Analytics Cloud. 

 

2.      SPONSOR: SAP America, Inc. (“Sponsor”), 3999 West Chester Pike, Newtown Square, PA 19073. 

 

3.      CONTEST ENTRY PERIOD:  The Contest begins at 09:00 AM PacificTime (“PT”) on July 1st, 2019 and ends at 11:59 PM (PT) on September 1st, 2019 (“Contest Entry Period”).The contest entry period can be extended by Sponsor in its sole discretion under the following situations: limited submissions, holidays, and unforeseen changes in events. If SAP deems one of these events to have negatively impacted the Contest, the Contest Entry Period will be extended for up to 15 additional days from the original Contest Entry deadline (related Contest deadlines will also be extended as needed). The extension will be announced up to 48 hours before the original end date. Entries, which include all components described in these Official Rules, must be received during the Contest Entry Period (or such other period of time within the Entry Period as designated in these Official Rules) by Sponsor in accordance with the procedure and approved channels stated herein, or will not be eligible. 

 

4.      ELIGIBILITY:The Contest is open to individuals (referred to as “Entrants”, or on occasion “you” or “your”) who: 

a.      are Students or SAP Partners;

b.      are the legal age of majority to form valid contracts in their respective country, province, or state of legal residence at the time the entry is submitted; and 

c.      are legal residents ofan Eligible Country. Please note that Eligible Countries differ for Students and Partners.  

 

Students: Students enrolled at a post-secondary institution that have a valid email address associated with said institution. 

 

Partners: SAP Partners are businesses that are registered as SAP Partners and are part of an official SAP Partner Program, such as PartnerEdge.

 

THIS CONTESTIS SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. THIS CONTEST IS VOID TO RESIDENTS OF ALL OTHER COUNTRIES AND WHEREVER RESTRICTED BY, WITHOUT LIMITATION, FILING OR REGISTRATION REQUIREMENTS, OR OTHERWISE PROHIBITED OR RESTRICTED BY LAW. 

 

5.      HOW TO ENTER:During the Contest Entry Period, Entrant must register for this Contest by providing the information requested (including a screen shot of your analysis) in the official entry form which can be downloaded here.(the “Entry”). You will need to obtain access to SAP Analytics Cloud, which will be subject to additional terms and conditions. Student Entrants participate by registering their name, email, and company/school in a simple registration form on the site. Student Entrants must use the SAP Analytics Cloud for Higher Education Hackathon tenant and associated data models for all analysis. Entrants may not edit or modify the Word template that they are required to submit as part of their Entry, and any Entry that Sponsor determines or has reason to believe has been edited or modified will be disqualified. It is the Entrant’s sole responsibility to ensure Sponsor has their current contact information. In whole or in part invalid, non-compliant or incomplete Entries will not be considered.Sponsor may but is not obligated to request that an Entry be re-submitted for corrective reasons, so long as it complies with these Official Rules and is submitted by the same, eligible Entrant within the Contest Entry Period. 

 

6.      Analytics Designer Hackathon Scoring (for the Prizes listed in Section 8, below): 

a.      Analytics Designer Hackathon Scoring will be done by the SAP Analytics Product Marketing and related Committeesthroughout the competition period (September 1st – September 15th).

b.      Scoring for the Contest will be judged based on the average score of all four judges. The judging criteria will consist of two sections, technical and non-technical, with a total and maximum score of 40. If more than one Entry has the same average score, then the Entry that was submitted the earliest will be named the winner.

c.      There will be a first place, second place and third place winner in each category (Students and Partners). In the event a potential winner is disqualified for any reason, the Entry that received the next highest total score will be chosen as the potential winner.

 

For purposes of these Official Rules "receipt" of your Entry occurs when Sponsor’s server records the information resulting from Entrant clicking the "Submit" (or equivalent) button. Only one (1) Entry from each Entrant is permitted. Any automated computer receipt (such as an email confirming the Entry) does not constitute proof of actual receipt by Sponsor for purposes of these Official Rules. Online Entries are subject to all notices posted online including but not limited to Sponsor’s terms of use and privacy policies on the Contest website. Sponsors are not responsible for lost, late, misdirected, ineligible, illegible, damaged, altered, or incomplete Entries. 

 

In order to be eligible for this Contest, all Entries, in whole and in part (and the Entrant) must comply with all other terms stated in these Official Rules, including the requirements in Section 5. Entrants agree that neither Sponsor nor SAP are responsible for, and they shall be indemnified, defended, released and held harmless for/from any claims, actions or disputes between an Entrant and any other Entrant and/or third party relating to the Contest or any Entry, in whole or in part.  Once you submit your Entry, it is final and may not be modified or edited. No Entry will be returned. 

 

The SAP Analytics Product Marketing Committee’s decisions are final and binding on all matters relating to this Contest. 

 

7.      INTELLECTUAL PROPERTY RIGHTS: With the exception of the rights granted in these Official Rules, as between Sponsor and the Entrant, the Entrant has and retains all intellectual and proprietary rights in and to the Entry that Entrant had at time of submission of the Entry. As a condition of entry, Entrant grants Sponsor, SAP, its affiliates, and others involved in the preparation of materials for, administration and execution of this Contest (“Contest Administrators”) a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, publicly perform, and publicly display the Entry in whole or in part that Entrant submits to this Contest to allow the Entry to be evaluated for purposes of this Contest, to administer the technical and other requirements of the Contest, including distribution of the Entry to the Contest Administrators, for prize award verification, and for promotional purposes. 

 

Entries may not be acknowledged and will not be received or held “in confidence” or “in trust” and by submitting an entry it does not create a confidential relationship or obligation of secrecy between Entrant and Sponsor, its affiliates, or any person or entity involved in the administration of the Contest. Entrants will not now or in the future be entitled to any approval, rights of compensation, or any other payment; unless adjudged and verified a winner pursuant to these Official Rules, and in such event, only to the extent of the prize award.

 

8.      PRIZES:Prizes will be awarded to the first place, second place, and third place winners for Students and Partners. Prizes differ for the two participant categories.  

The top three (3) STUDENT ENTRIES will receive the following (i.e., 3 total prizes): 

First Place  Conference Pass to SAP TechEd Las Vegas 2019 and a chance to present his/her work.  

Second Place – Nintendo Switch (Valued at 379.99 CAD) 

Third Place – Bose Audio Sunglasses (Valued at 268.03 CAD) 

 

The top three (3) PARTNER ENTRIES will receive the following (i.e., 3 total prizes): 

First Place  Conference Pass to SAP TechEd Las Vegas 2019 and a 1st place trophy   

Second Place – 2nd place trophy  

Third Place – 3rd place trophy  

 

Odds of winning depend on the number of Entries received and the skill of the Entrants as determined under these Official Rules. No other prize elements except those specifically described here are awarded. Prizes are not transferable and must be accepted as awarded, with no substitutions of any kind, except by the Sponsor, which reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value, at its sole discretion. If a 1st place winner is unable to use the Conference Pass and attend TechEd, Sponsor may, in its sole discretion, award the prize to an alternate winner (i.e., the initial winner would forfeit the award), which would be the next highest scoring Entry.  All federal, state and local taxes, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the potential winner’s responsibility (e.g., any customs duty). All prize details are at the Sponsor’s sole discretion. 

 

The Student winner will also be offered a reimbursement of transportation, lodging, meal expenses directly associated with travel to and from, and attendance of TechEd up to USD $2,500. All expenses incurred must be generally consistent with SAP’s travel policies.  The Student winner must provide Sponsor with receipts within thirty (30) days of the TechEd event for all expenses for which reimbursement is requested.  All other costs and expenses incurred during the trip are the responsibility of the Student winner. In the event the Student winner engages in behavior that, as determined by Sponsor (or its designee) in their absolute discretion, is obnoxious or threatening, dangerous, illegal, disorderly, or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip early for that individual, and to send that participant home with no further compensation.

 

Sponsor will only be awarding conferences passes as Prizes for the Partners.  All transportation, lodging, meals, gratuities, and all costs and expenses relating to the use of the tickets are the responsibility of the Partner winner.

 

 

9.      PRIZE NOTIFICATION: Potential winners will be notified on or about September 10th, 2019, online, by email, and/or mail at Sponsor’s sole discretion based upon the information submitted by the Entrant. The prize winners may be required to complete, sign, and return an Affidavit of Eligibility and Release of Liability and Publicity Release (where permissible by law) (collectively “Affidavit”) within the time/date specified by Sponsor. Failure to comply within this time deadline will result in disqualification and the Entrant with the next highest score will be notified.If any prize winner cannot be contacted using the contact information provided on or within two (2) separate attempts, or if Affidavit/Release is returned as undeliverable, or if a prize winner cannotaccept or receive the prize that they were awarded for any reason, or any non-compliance with these Official Rules, that prize will be forfeited and awarded to the Entrant with the next highest score. 

 

10.   FREE STUFF:  In addition to the award of prizes, Entrants may also receive SAP branded giveaways, while supplies last, or other secondary prize awards of nominal value chosen by SAP. Any and all costs other than shipping are the responsibility of the recipient.

 

11.   GENERAL ENTRY CONDITIONS:Sponsor is not responsible for problems uploading or downloading any Contest related information from the website or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic entry submission to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the website, or any other technical problems related to web site entries including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit an Entrant’s ability to participate in this Contest. If applicable, mass entries or entries generated by a script, robot, macro, or use of automated devices will be disqualified. Sponsor reserves the right to modify, suspend or terminate the Contest in the event it becomes infected by a computer virus or is otherwise technically impaired, and to cancel or suspend the Contest in its entirety should tampering, unauthorized intervention, fraud, technical failures or other causes beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. Sponsor reserves the right at their sole discretion to disqualify any individual they find to be tampering with the entry submission process or the operation of this Contest or web site or to be acting in violation of the Contest Official Rules. 

 

Without limiting any other right or term herein, an Entrant may be disqualified from the Contest if, in Sponsor’s absolute discretion, it reasonably believes Entrant has, appears to, or has attempted to undermine the legitimate operation of the Contest by cheating, deception, fraud, using multiple identities, engaging in illegal activities, or other unfair practices, or has or attempts to annoy, abuse, threaten, harass or intimidate any other Entrant, or any other person. 

 

Sponsor is not responsible if the Contest cannot take place or if any prize cannot be awarded due to travel cancellations, delays, or interruptions due to acts of God, acts of war, natural disasters, weather, or acts of terrorism. Sponsor reserves the right to cancel or suspend the Contest at its discretion. Sponsors are not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prizes. 

 

12.   PRIVACY:Entrantsagree that personal data entered during the registration may be processed, stored, and otherwise used for the purposes and within the context of the Contest and as permitted by and in accordance with the Sponsor’s Privacy Policy found athttps://www.sap.com/about/legal/privacy.html. This data may be collected and maintained within the United States. By entering, Entrants expressly agree to the transmission, processing, and storage of this personal data in the United States. 

 

13.   LIMITATION OF LIABILITY. THESE OFFICIAL RULES SHALL GOVERN THE CONTEST, INCLUDING BUT NOT LIMITED TO ENTRY, PARTICIPATION, ELIGIBILITY TO RECEIVE A PRIZE, AND ENTRANTS AND OUR RESPECTIVE OBLIGATIONS WITH RESPECT THERETO. USE OF THE SITE, INFORMATION PRACTICES, AND ALL OTHER GENERAL TERMS ARE GOVERNED BY SPONSOR’S TERMS OF USE AND/OR PRIVACY POLICY AT SAP.COM. IN THE EVENT OF A DISCREPANCY BETWEEN ANY INFORMATION, COMMUNICATION, AND/OR TRANSLATION, THESE OFFICIAL RULES SHALL GOVERN ISSUES RELATING TO THE CONTEST. 

 

IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THIS CONTEST, PARTICIPATION IN THE CONTEST, ANY CONTEST ACTIVITIES OR ELEMENTS THEREOF, INCLUDING BUT NOT LIMITED TO THE SUBMISSION OF AN ENTRY, ENTRANT’S ACCESS TO AND USE OF THE PROMOTIONAL WEBSITES OR THE UPLOADING OF MATERIALS TO THE WEBSITE, AND/OR THE DELIVERY, ACCEPTANCE AND/OR USE/MISUSE OF A PRIZE. 

 

14.   RELEASE AND INDEMNIFICATION:To the maximum extent permitted by law, Entrants and winners agree to release, indemnify, defend and hold harmless (“release”) Sponsor, SAP, and their parents, affiliates, subsidiaries and divisions, and their respective directors, officers, employees and agents (“Released Parties”) from and against any and all threatened or actual actions, liabilities, claims, demands, losses, settlements, fines, damages, costs and expenses (including reasonable attorney fees) whether or not litigation is commenced (“dispute”) arising at any time from participation in the Contest, the Entries (in whole or in part), any Contest and/or prize-related activity. Entrants and winners covenant not to sue any Released Party or cause them to be sued regarding any matter released above; and further covenant not to disaffirm, limit, or rescind this release. A waiver by Sponsor of any term in these Official Rules does not constitute a waiver of any other provision.  Except where prohibited by law, acceptance of any prize constitutes permission for Sponsor and its designees to use the winner's name, likeness, statements, and other personally identifiable information provided in connection with the Contest for advertising and marketing purposes in any media throughout the world without any additional prize, incentive, consideration, consent or review. 

 

15.   APPLICABLE LAW:These Official Rules shall be governed by, subject to, and construed in accordance with the laws of the State of New York, United States of America, without regard to conflict of law rules. If any item or provision contained in these Official Rules or any part thereof is declared or becomes unenforceable, invalid or illegal for any reason, all other terms and provisions of these Official Rules shall remain in full force and effect as if these Official Rules had been executed without the offending provision appearing therein. 

 

16.   NAMES OF WINNERS:Winners will be named and published on or about September 10th, 2019. Visit the Contest page for results. 

 

Sponsor reserves the right, without notice or prior approval, to modify or supersede these Official Rules in its sole reasonable discretion and in such event will post revised Official Rules on the web site, which will continue to govern all aspects of the Contest.
